The U.S. Department of Education’s Office of Safe and Drug-Free Schools (OSDFS) awards grants to local education agencies and other public and private entities to develop and implement, or expand, school-based drug-testing programs for students. The drug testing funded by these grants must be part of a comprehensive drug-prevention program in the schools served, and provide referral to a student assistance program, counseling, or drug treatment if necessary for students identified as drug users through the testing program. Projects funded by these grants also must be consistent with constitutional principles and all applicable state and federal laws and requirements regarding student drug testing, and must ensure the confidentiality of testing results.
Any drug-testing program conducted with funds awarded must be limited to one or more of the following:
- Students who participate in the school's athletic program
- Students who are engaged in competitive, extracurricular, school-sponsored activities
- Students who, along with their parent or guardian, have provided written consent to participate in a voluntary random drug-testing program
